Privacy Notice
This document represents the "Privacy Notice" of Berlitz de México, (hereinafter the "Company"), with address to hear and receive notifications at Jaime Balmes #11 Torre A 6th floor, which is made available to you (the "Data Subject") prior to the collection and processing of your personal data.
I.- Object. This Privacy Notice regulates the form, terms and conditions under which the Company, including its subsidiaries and related companies, are entitled and authorized by the Data Subject to obtain, process and transfer the personal data (hereinafter the "Data") of the Data Subject.
II.- Excluded Data. The Company’s website may include links to third party websites. If you access such links, you will leave the Company’s website and the Company assumes no responsibility or liability in connection with such third party websites.
If you post, comment or share personal information, including photographs, in any public forum, social network, blog or other such forum, you should be aware that any personal information you post may be read, viewed, collected or used by other users of such forums, and may be used to contact you, send you unsolicited messages or for purposes that neither you nor the Company can control. The Company is not responsible for the personal information you choose to submit to these forums or social networks.
III.- Consent. The Data Subject hereby states, under oath to the truth:
That in case this “Privacy Notice” is available through an electronic page (Web site, Internet page or similar) or any other electronic device, by “clicking” on “accept” or otherwise continue browsing the site, or by providing your Data through the same, constitutes a manifestation of your consent for the Company to carry out the processing of your Data, in accordance with this “Privacy Notice”.
That in the event that this "Privacy Notice" is available through audio, audiovisual or any other technology, the fact of providing your Data constitutes a representation of your consent for the Company to carry out the processing of your Data, in accordance with this "Privacy Notice".
That in the event that this "Privacy Notice" is available in writing, your signature, rubric, name or fingerprint or by providing your Data in any part of the site, constitutes a representation of your consent for the Company to perform the processing of your data, in accordance with this "Privacy Notice".
That all information you provide is truthful and complete. The Data Subject shall be liable at all times for the Data provided.
The Data Subject has the right to access, rectify and cancel his or her Data, as well as to oppose the processing thereof or revoke the consent he or she has granted us for such purpose, through the procedures set forth in this Privacy Notice.
IV.- Sensitive Data. The Data Subject states under oath that he/she has not provided and in no case will provide the Company with “sensitive personal data”, that is to say, those intimate personal data or whose due or improper use may give rise to discrimination or entail a serious risk for him/her.
In particular, the Data Subject undertakes not to provide the Company with any Data concerning racial or ethnic origin, present and future health status, genetic information, religious, philosophical and moral beliefs, trade union membership, political opinions or sexual preference.
V.- Data collection. The Data Subject will voluntarily provide his/her Data to the Company, either in writing, verbally, electronically, through surveys, direct access to the Company’s website or by sending electronic files or of any other nature, including but not limited to, direct delivery of information, access to the Company’s website or that of its customers or affiliates (where reference is made to this Privacy Notice), telephone or telemarketing calls, e-mail requests, seminars, congresses or events, etc.
In case of use of, or access to our Internet sites or other electronic means, we inform you that our systems may collect Data of the Data Subject such as type of browser, operating system, Internet pages visited, IP address, etc., through “cookies” or “web beacons”, among others. Cookies are text files that are automatically downloaded and stored on the hard disk of the user’s computer equipment when browsing a specific Internet page, which allow the Internet server to remember some information about the user, including his preferences for viewing pages on that server, name and password. Web beacons are images inserted in an Internet page or e-mail, which can be used to monitor the behavior of a visitor, such as storing information about the user’s IP address, duration of interaction time on that page and the type of browser used, among others.
The Data Subject agrees that the Company may also obtain Data about the Data Subject from other means, such as information obtained from other commercially available sources, e.g. phone directories, employment directories, business cards, public databases, etc.
All information and Data we collect about the Data Subject may be combined for the purposes permitted under this Privacy Notice.
VI.- Data Use. The Company may use the Data for any of the following purposes:
Improvement of the commercial process - In case of statistical information, internal processing data, commercial promotions, marketing studies, commercial offers, surveys, advertising matters or similar, we may require general information such as name, address (home and office), phone numbers, fax and e-mail address, information on commercial or consumer preferences, income ranges, education ranges, age ranges and/or socio-economic level ranges.
This Data may be used, but not limited to (i) Provide you with the goods and/or services that you have requested or in which you have expressed interest; (ii) Provide an efficient service and provide better attention to the user, as well as to improve your experience in the use of certain products and/or services; (iii) Send you and introduce you to goods and/or services that may be relevant or attractive, including your participation in promotions, offers and advertising campaigns; (vi) Inform you about changes or new products or services that are related to the one contracted or acquired by the client; (v) Fulfill obligations contracted with our clients; (vi) Evaluate the quality of service, or conduct internal studies on consumption habits.
Contact or employment information - In the case of job offers or applications, submission of resumes or curriculum vitae, employment records or any other similar, data such as name, address, phone numbers, mobile phones, fax, e-mail, photographs, information on academic degrees, academic and employment history (previous jobs) and data related to interest in jobs, including skills and abilities, contact information, socioeconomic level and job expectations (including salary) may be requested or provided.
These Data may be used for (i) internal purposes of the Company, including keeping them as labor records within the Human Resources area of the Company; (ii) Labor recruitment processes or independent service provision; (iii) For the purpose of providing references in case another person or company requests reports on possible candidates for a position, job or commission; (iv) For internal legal purposes, including compliance with Social Security or similar obligations; (v) For the purpose of publishing them in case they are required as part of a human resources supply strategy.
Information for commercial operations. - In case Data is requested to perform a commercial transaction, information such as financial information, including credit card number; and other sensitive information, such as user identification and passwords, billing or transactional information, bank details, etc., may be requested.
The above specified financial information, including credit card numbers, is used exclusively to process credit applications, payments and for fraud prevention.
This purpose may be achieved through the processing and use of the Data directly through the Company or through third-parties to whom the data is transferred in accordance with the provisions of the following section.
VII.- Data storage, disclosure and transfer. Data may be transferred to, stored and processed in a country other than where it was provided, in which case we transfer the information in accordance with applicable data protection laws.
The Data Subject understands and agrees that the Company is authorized to use, store, disclose, transfer, sell, assign, lease or otherwise market or transfer the Data. In this case, the Company will enter into contracts with relevant third-parties to whom the Company provides the Data, in which the restrictions and other terms and conditions of this Privacy Notice shall be incorporated.
If you do not express your disagreement for your Data to be transferred, it shall be understood that you have given your consent to do so.
Notwithstanding the foregoing, the Company may also provide some Personal Information to suppliers of goods or services who need to know such information. Such providers include, but are not limited to, credit card processors, providers of customer service and support provided on a real-time basis, marketing, e-mail service providers, automated data processors and carriers. Such service providers are contractually obligated to maintain the confidentiality of the Data in accordance with this Privacy Notice.
VIII.- Data storage. Once collected, the data will be processed and stored in a database that may be managed by the Company or by a third-party (within or outside the country where the Data was provided) with whom the Company has a contract for such purposes.
Company will incorporate protection mechanisms in order to avoid “as far as possible” deviations, adulteration, loss, consultation or unauthorized processing of the Data.
IX.- Non-Disclorure. Data will not be disclosed by the Company to unauthorized third-parties except when such disclosure is required by law or by order of an authority.
X.- Access, rectification. The Data Subject shall have the right to access his/her personal information stored in the Company’s database and rectify, limit or update it when required, for which he/she shall send a request by mail or e-mail to the Person in Charge, under the following details:

Requests for access, rectification, cancellation or objection must contain and be accompanied by the following:
- The name of the Data Subject and address or other means of communicating the response to your request;
- Supporting documents proving the identity or, as the case may be, the legal representation of the Data Subject
- The clear and precise description of the personal data with respect to which the exercise of any of the aforementioned rights is sought, and
- Any other element or document that facilitates the location of the Data Subject’s personal data.
XI.- Cancellation or Revocation. In case of requests for total cancellation of Data or revocation of consent, such requests shall be made in accordance with the provisions of the preceding paragraph.
Data cancellation will give rise to a blocking period after which the Data will be deleted. Data may be retained by the Company solely for the purposes of the liabilities arising from the processing.
Where Data had been transmitted prior to the date of rectification or cancellation and continue to be processed by third-parties, the Company shall inform you of such request for rectification or cancellation, without any further obligation on your part.
The Company shall not be required to delete any Data when:
Must be processed as required by law;
Obstructs judicial or administrative proceedings related to tax obligations, the investigation and prosecution of crimes or the updating of administrative sanctions;
They are necessary to protect the legally protected interests of the Data Subject;
They are necessary to carry out an action in the public interest;
Are necessary to comply with a legally binding requirement.
XII.- Amendments. The Company hereby expressly states that it is entitled to amend these privacy policies at any time in order to adapt them to new legislation, jurisprudence and market practices.
The Data Subject hereby consents and agrees that any change to this "Privacy Notice" or to the privacy policies shall be notified by means of its posting on the web page www.berlitz.com/es-mx. It is mandatory for the Data Subject to periodically visit said site in order to verify the most current version of the Privacy Notice.
