Terms and conditions

The following general terms and conditions ("GTC") of SPA BERLITZ ALGERIA 38,Lot de la petite Provence. Hydra,ALGER ALGERIA, ("Berlitz") shall apply as the binding basis for all contractual relationships between Berlitz and consumers and entrepreneurs (also referred to as "customers") who acquire products and services offered by Berlitz via the Internet on this website.

This site is intended for customers residing or domiciled in the country where Berlitz is located.

A "consumer" is defined as any natural person who concludes a legal transaction for a purpose that does not correspond to his or her commercial or professional activity.

An "entrepreneur" is defined as any natural person, legal entity or trading company who, in concluding a legal transaction, does so in the exercise of his commercial or professional activity.

The rules of these GTC which are expressly designated as applying to consumers do not apply to entrepreneurs.

When a transaction is concluded via the Internet on this site, the customer must accept these GTC and confirm the purchase by clicking on the corresponding buttons.

The customer has the option of reading and printing these GTC before clicking on acceptance.

Certain services and/or products offered by Berlitz may be subject to separate or additional contractual conditions that supplement the provisions of these GTC.

These are mentioned separately in the corresponding section of the product/service and are applicable to a given service or product.

These separate terms and conditions, which differ from these GTC, take precedence over the provisions of these GTC.

In addition to the online purchase option via this website, a customer may also conclude a Berlitz training contract by signing a contract at a Berlitz Center.

A customer who concludes a contract with Berlitz for a participant in the capacity of legal guardian acknowledges and agrees that all contractual provisions also apply to the participant.

When placing an order on behalf of participants, the customer assures Berlitz that the participants have read these GTC and will comply with them.

The times and appointments specified by Berlitz are subject to the availability of suitable instructors. If an instructor is unable to keep an appointment, Berlitz will make every effort to find a replacement.

If lessons or programs are cancelled by Berlitz, Berlitz will offer replacement lessons and programs accordingly.

Berlitz agrees that if this is not possible in a particular case, Berlitz will notify the customer immediately and, upon completion of the program, will refund the customer for any lessons that were paid for but not completed due to Berlitz.

Customers are not entitled to be taught by a particular instructor.

A change of instructor may be part of the Berlitz method and does not entitle the customer to withdraw from or cancel the contract.

Berlitz will decide which level/group the customer should participate in.

For pedagogical reasons, Berlitz has the right to move a client from one level/group to another or to modify the course content.

Berlitz undertakes to carry out a thorough needs analysis and to provide customers with a goal-oriented training plan, but is not responsible for the non-achievement of specific learning and training goals, as this depends in particular on the customer's appropriate participation as well as on his or her personal learning abilities, which are outside Berlitz's sphere of influence.

Berlitz is not liable if the customer does not achieve a certain level of learning and educational success.

Berlitz statements regarding the lessons required to achieve a particular educational goal are based on many years of experience and may differ from what is actually required in individual cases.

Only persons who have been assigned a personal user name and password may access an online service.

You expressly agree to protect the access data and passwords received in the customer area in such a way as to prevent unauthorized use of Berlitz services by third parties.

A language program is valid for 12 months from the date of contract. Berlitz does not reimburse its customers for licenses that have not been used or have been used infrequently.

The client has the right to modify or cancel scheduled lessons before noon on the previous business day.

If the customer cancels too late or fails to show up, the scheduled lessons will be billed. Private lessons are scheduled at pre-established intervals and can only be rescheduled within the same week.

If a Berlitz test is cancelled two days before the scheduled test, Berlitz will refund the purchase price. If the cancellation is received after the stipulated deadline, the purchase amount will not be refunded.

Berlitz reserves the right to exclude customers from the lesson and the rest of the course program if they disrupt the lesson in such a way that it becomes impossible for other customers to follow training in accordance with the contract.

In this case, the tuition fees paid for unused lessons will be refunded by Berlitz.

No refunds will be made for prepaid course materials received by the customer, nor for registration fees.

Consumer right of withdrawal for distance selling contracts.

If you are a consumer, you have the right to withdraw within 8 days of the date on which the contract was concluded via this website.

This right of withdrawal applies only to consumers and not to entrepreneurs.

To exercise the consumer's right of withdrawal, you must inform us of your decision to withdraw from the contract in a clearly worded statement sent to our postal address or electronically to the e-mail address info@berlitz.dz. We will immediately send you confirmation (e.g. by e-mail) of receipt of your declaration of withdrawal.

If you have started using the services within the withdrawal period, you agree that the 8-day right of withdrawal does not apply.

Berlitz services and products are invoiced at the prices in effect at the time the order is placed on this website.

The prices shown on this website include statutory value-added tax where applicable.

Berlitz reserves the right to change prices without prior notice, but this shall not affect contracts already signed.

Berlitz reserves the right to change or remove products/services from this web site without notice.

Payment by credit card. Berlitz uses an external service provider to process payment transactions on this website. Berlitz does not store credit card data.

Customer data is stored when the contract is concluded, in particular for the purpose of contract execution, and is retained for the period of time required by law.

Please note our website's privacy statement.

With the exception of any transmission required by law or necessary for the performance of the contract, data is only transferred to a credit card company or to the shipping company in the case of material delivered by post.

Berlitz uses and processes each customer's personal data for promotional purposes by sending the customer information about goods or services similar to those already ordered or booked.

The customer may revoke authorization to use his or her data at any time by sending an e-mail with the subject "Data" to info@berlitz.dz.

Technical requirements for participation in online courses.

The customer is personally responsible for fulfilling, at his or her own expense, the technical requirements relating to hardware and software as well as any other technical equipment necessary to participate in virtual forms of training.

Berlitz will only provide information on the necessary technical requirements in good time. Lessons that cannot be taken due to technical faults on the part of the customer must be paid for without exception.

Recording of live online courses.

The customer agrees that certain live online programs may be recorded by Berlitz and subsequently made available to participants on their portal.

Quality Assurance.

The customer agrees that an educational specialist employed by Berlitz may attend a lesson - whether face-to-face or online - for quality control purposes.

Berlitz owns the intangible rights to all materials/products made available to the customer and offered by Berlitz.

No part of the Berlitz materials/products may be used externally without the prior written consent of Berlitz.

The customer shall not be entitled to transfer its contractual rights or obligations, in whole or in part, to third parties without the prior written consent of Berlitz.

This agreement is subject to Algerian law and Algerian courts.The place of jurisdiction shall be the town where Berlitz has its registered office, unless the customer is a consumer and the laws applicable to consumers provide for a different place of jurisdiction.

As part of our online offering, we are required to refer you to the European Commission's Online Dispute Resolution (ODR) platform.

Should any of the above provisions be or become ineffective, this shall not affect the validity of the remaining provisions.
