INFORMATION OBLIGATION FOR PARTICIPANTS OF LANGUAGE COURSES/TRAINING ORGANIZED BY BERLITZ SP. Z O.O. AND FOR PERSONS PERFORMING TASKS RESULTING FROM THE CONTRACT

The Controller of the personal data for the participants of the training/language courses and the persons performing the tasks resulting from the execution of the contract indicated by the Client is Berlitz Sp. z o.o. with its registered office in Warsaw, 69 Prosta St., hereinafter referred to as Berlitz.

Berlitz will process the data of the contact persons indicated by the Client in the contract in order to fulfill the rights and obligations arising from the contract, as well as the data of the participants of the training/language courses based on the provisions of educational law as a Non-Public Continuing Education Institution in accordance with the approved statute.  Following the principle of data minimization, the personal data of the above-mentioned persons are only business data: name, position, business e-mail address and business telephone number. Within the framework of mutual sharing after the completion of the training/course, Berlitz will make available to the Client the data of the training participants in the form of: learning progress, attendance list and certificate of completion of the training/course.

In addition, the personal data of the aforementioned persons may be processed for the purpose of asserting legal claims arising from or related to the contract - Article 6 .1.f GDPR and legal obligation under the provisions of the Tax Code - Article 6 .1.c.

Personal data may be shared with Berlitz's subcontractors only for the purpose of contract execution, i.e. entities that provide consulting, shipping, IT, archiving, document shredding services, and inspection authorities.

 In order to conduct the training/online course, Berlitz may share course participant data outside the EEA e.g. to the USA via digital platforms i.e. MS Teams/ZOOM/Calture. The data that may be shared outside the EEA is only telemetric data i.e. IP address, email address, browser name and operating system. Online trainings take place in real time and are not recorded or copied.

We assure you that in such a case where the aforementioned course participant data is transferred outside the EEA, it will only be done with an appropriate degree of protection and with the application of applicable legal measures:

• cooperation with processors of personal data in countries for which a relevant decision of the European Commission has been issued regarding the determination of an adequate level of personal data protection;
• use of standard contractual clauses approved by the European Commission;
• application of binding corporate rules approved by the relevant supervisory authority;

The personal data referred to above shall be processed for the duration of the contract and the period reserved by law, but not less than until the expiration of mutual claims arising from the contract, as well as for the duration of storage of certificates of completion of the course, but no longer than one year.

Each aforementioned person will be able to exercise his/her rights, i.e.

• access to such data,
• rectification of this data,
• deletion of this data,
• transfer of such data,
• to limit the processing of such data,
• not be subject to automated decision-making, including profiling,
• to lodge an objection,
• o to lodge a complaint with the President of the Office for Personal Data Protection, located at 4 Stawki Street in Warsaw.
